This page contains the Terms of Use, Privacy Notice, Cookie Notice, and service disclaimers for Volaris EV Innovations, Inc. ("Volaris," "we," "us," or "our") and the website at volarisev.com (the "Site"). Please read it carefully. By using the Site or submitting a request through it, you agree to these terms.

1. Terms of Use

Who we are. The Site is operated by Volaris EV Innovations, Inc., a Texas corporation, with a place of business at 154 N Festival Dr, Building D, El Paso, TX 79912. You can reach us at volarisev@gmail.com or (915) 219-8901 or (915) 219-9037.

Informational purpose. The Site is an informational and inquiry site. Nothing on the Site is an offer to sell, a binding quote, a warranty, or professional electrical, engineering, tax, or legal advice. Product descriptions, images, specifications, charging speeds, and installation timelines are provided for general information and may change without notice.

No prices on the Site. We do not publish pricing. All work is priced by written quote following an assessment of your property and electrical service.

Eligibility. You must be at least 18 years old and legally able to enter into contracts to submit a request through the Site.

Acceptable use. You agree not to use the Site to submit false information or another person's contact information without permission; to attempt to gain unauthorized access to the Site or its systems; to scrape, harvest, or use automated means to collect data from the Site; to introduce malware; or to use the Site for any unlawful purpose.

Our content. All content on the Site, including text, graphics, logos, and photographs, is owned by us or our licensors and is protected by copyright and trademark law. You may view and print pages for your own non-commercial use. You may not otherwise reproduce, distribute, or create derivative works from the content without our written permission.

Content you submit. Please do not send us confidential or sensitive information through the Site. Information you submit through a form or chat window is not confidential, and you grant us permission to use it to respond to your inquiry and operate our business.

Third-party links. The Site may link to third-party websites. We do not control and are not responsible for their content, products, or privacy practices.

Disclaimer of warranties. THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. This paragraph applies to the Site only. It does not limit any warranty stated in a signed contract for products or installation services.

Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms waives any right you have under the Texas Deceptive Trade Practices–Consumer Protection Act.

2. Quotes, Installation, and Service Disclaimers

Quotes are estimates until accepted. Any quote we provide is based on the information available at the time and on conditions we can observe. Quotes are valid for 30 days from the date issued. Final pricing may change if we discover conditions that were not visible or disclosed, including panel capacity limits, existing code violations, concealed wiring, or the need for a service upgrade. We will tell you before performing any work beyond the quoted scope.

Site suitability. Not every home can support a Level 2 charger without modification. A Level 2 unit runs on a dedicated 240-volt circuit and may require an electrical panel or service upgrade. We will tell you if we believe your property requires additional work, but we do not guarantee that any particular property is suitable.

Licensed work. Electrical work arranged through Volaris is performed by independent, Texas-licensed electrical contractors, not by Volaris employees. Those contractors are separately licensed and insured and are responsible for performing the work in accordance with the National Electrical Code and applicable local amendments. On request, we will identify the licensed contractor assigned to your project and provide their Texas electrical contractor license number.

Permits and inspections. Level 2 installations generally require an electrical permit and inspection from the local building authority. The licensed contractor performing your installation obtains the required permit and coordinates inspection. Permit and inspection fees are included in your quote.

Utility coordination. Service upgrades may require approval and scheduling by your electric utility. We do not control utility timelines.

HOA, landlord, and property restrictions. You are responsible for obtaining any approval required by a homeowners association, landlord, or property owner before installation.

Warranty. Charging hardware is covered by the manufacturer's warranty, which we pass through to you in full. For the Tesla Wall Connector, that warranty is four years for residential use, subject to the manufacturer's own terms, conditions, and exclusions, which may include a requirement that the unit be installed by a licensed electrician. We make no independent warranty on hardware.

Separately, Volaris warrants the installation and workmanship for one year from the date the installation is completed. This workmanship warranty does not cover the hardware itself, damage caused by misuse, modification or repair by anyone other than us or our assigned contractor, power surges, flooding, weather, pests, vandalism, or pre-existing conditions in your home's electrical system. Warranty claims must be submitted to volarisev@gmail.com or (915) 219-8901 or (915) 219-9037.

Vehicle compatibility. You are responsible for confirming that any charging equipment or adapter you purchase is compatible with your vehicle and with your vehicle manufacturer's warranty and terms of use. Vehicle manufacturers may restrict or discourage the use of third-party adapters. We do not guarantee compatibility with any specific vehicle, charging network, or future vehicle or network software change.

Residential use. Our residential products and services are intended for private, non-commercial use at a private residence.

3. Trademarks and Third-Party Brands

Tesla, Tesla Wall Connector, Supercharger, and related names and logos are trademarks of Tesla, Inc. Volaris EV Innovations, Inc. is an independent business and is not affiliated with, authorized by, endorsed by, or sponsored by Tesla, Inc. or any vehicle manufacturer. Any reference to Tesla, or to any other manufacturer or model, is made solely to identify equipment and compatibility and does not imply any relationship between us and that company. All other trademarks are the property of their respective owners.

4. Tax Credits, Rebates, and Incentives

Any information on the Site about federal tax credits, state or local incentives, or utility rebate programs is general information only and is not tax advice. Program terms, funding, income limits, geographic eligibility, and deadlines change frequently and are set by third parties, not by us. We do not guarantee that you will qualify for any credit, rebate, or incentive, and we are not responsible for any amount you expected to receive and did not. Consult a qualified tax professional and confirm current program terms with the administering agency or utility before making a purchase decision.

5. Your Right to Cancel an In-Home Purchase

If you sign a purchase or installation agreement with us at your home, or anywhere other than our place of business, Texas law gives you the right to cancel that agreement until midnight of the third business day after the date you sign it. You do not need a reason to cancel.

At the time you sign, we will give you two copies of a Notice of Cancellation form, and that notice controls. To cancel, sign and date one copy and deliver or mail it to Volaris EV Innovations, Inc., 154 N Festival Dr, Building D, El Paso, TX 79912. If you mail it, it is effective on the date it is postmarked. If you cancel in time, we will return any payment you made within ten days, and you make any goods delivered to you available for pickup in substantially the same condition you received them.

This section summarizes your rights. The Notice of Cancellation delivered with your signed agreement is the official notice, and nothing here limits it.

6. Privacy Notice

Our providers process information on our behalf under their own terms and privacy policies. We may also disclose information to professional advisors, to comply with legal process, or in connection with a sale or transfer of the business.

You can opt out through our cookie preferences link or by sending a Global Privacy Control signal. See Your Privacy Rights.

7. Calls, Texts, and Email Consent

When you submit a form or start a chat and provide your phone number, you are asking us to contact you about your inquiry. We will call, text, or email you about that request.

Separately, and only if you check the marketing consent box, you agree that Volaris EV Innovations, Inc. may send you promotional calls and text messages at the number you provided, including messages sent using automated technology. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. Reply STOP to opt out of text messages at any time, or HELP for help. You can unsubscribe from marketing email using the link in any message, or by contacting us at volarisev@gmail.com.

We honor opt-out requests promptly and maintain a do-not-contact list.

8. Cookie and Tracking Notice

Cookies are small files stored on your device. We use them, along with similar technologies such as pixels and tags, in the following categories:

  • Strictly necessary: required for the Site to function and to protect our forms from spam and abuse (Google reCAPTCHA). These cannot be turned off through our banner.
  • Analytics: to understand how visitors use the Site.
  • Advertising: to measure ad performance and to show you relevant ads on other sites.
  • Functional: our chat widget, which loads only after you consent and which transmits what you type to our chat provider.

Your choices. Analytics, advertising, and functional cookies are set to off until you accept them. You can accept, reject, or customize categories in the banner shown when you first visit, and change your choice at any time using the "Cookie Preferences" link in the Site footer. We also honor Global Privacy Control and similar browser opt-out signals as a valid opt-out of targeted advertising. You can additionally block or delete cookies in your browser settings, though parts of the Site may not work properly.

9. Your Privacy Rights

Texas residents. Under the Texas Data Privacy and Security Act, Texas residents may have the right to confirm whether we process their personal data and to access it; to correct inaccuracies; to request deletion; to obtain a portable copy; and to opt out of targeted advertising, the sale of personal data, and certain profiling.

How to submit a request. Email volarisev@gmail.com with the subject line "Privacy Request," or call (915) 219-8901 or (915) 219-9037. You may authorize an agent to act on your behalf.

If we deny the appeal, you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov.

Residents of other states with comprehensive privacy laws may have comparable rights, and we will honor those requests where the law applies to us.

10. Governing Law and Disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Site or these terms will be brought exclusively in the state or federal courts located in El Paso County, Texas, and you consent to personal jurisdiction and venue there.

Nothing in this section limits any right you may have under the Texas Deceptive Trade Practices–Consumer Protection Act or your cancellation rights described in Section 5.

11. Changes and Contact

We may update this page from time to time. The "Last updated" date at the top shows when it last changed. Material changes will be posted here, and your continued use of the Site after we post them means you accept them.
